Accordingly, the Member States of the World Health Organization have began work on a new international instrument aimed at better protecting people, communities and states from future pandemics and improving global preparedness and response to pandemics, which resulted in the adoption of the Pandemic Agreement with 35 articles, many of them cover issues not previously covered by any international rules.<br><br>The provisions of the Pandemic Agreement can be divided into three general categories: the international cooperation approach, the health-based approach and the governance-based approach. During the negotiations, states adopted various positions on each article, such as opposition, divergence, convergence (a stage less than agreement and more than opposition or non-convergence) and agreement. The study of the articles of the pandemic agreement shows that in some cases, international cooperation is a sacrifice to the sovereignty and interests of states. In fact, the provisions of the agreement wherever seek to strengthen, sovereignty, the states have been agreed with them, and wherever there has been a fear of sovereignty being shaken, states have shown reactions such as divergence and opposition. آثار مخربی که کووید-19 بر دولت‌ها و به طور کلی جامعه بین‌المللی گذاشت، نقاط ضعفِ قابل توجه در چارچوب‌های حقوقی جهانی برای مقابله با بیماری‌های همه‌گیر را نمایان ساخت. از این روی، دولت‌های عضو سازمان بهداشت جهانی، کار بر روی یک سند جهانی جدید که هدف آن محافظت بهتر از مردم، جوامع و دولت‌ها در برابر همه‌گیری‌های آینده و ارتقاء آماده سازی و واکنش جهان در برابر همه‌گیری‌ها بود را آغاز کردند که نتیجه آن تصویب توافقنامه همه گیری با ۳۵ ماده که مفاد بسیاری از آنها مسائلی را دربر می‌گیرد که قبلاً در هیچ مقرره بین‌المللی پیش‌بینی نشده‌اند، بود. <br><br>مفاد توافقنامه همه‌گیری را می توان در سه دسته کلی رویکرد همکاری بین‌المللی، رویکرد سلامت محور و رویکرد حاکمیت محور قرار داد که دولت ها در طول مذاکره نسبت به هریک از مواد، مواضع گوناگونی چون مخالفت، واگرایی، همگرایی (مرحله ای کمتر از توافق و بیشتر از مخالفت یا عدم همگرایی) و توافق اتخاذ کردند. مطالعه مواد توافقنامه همه‌گیری گویای آن است که در مواردی همکاری بین‌المللی قربانی حاکمیت و منافع دولت‌ها است. در واقع، هرجا که مندرجات در مقرره‌ای به دنبال تثبیت و تحکیم حاکمیت بوده با توافق دولت‌ها مواجهه شده و هرجا که بیم تزلزل حاکمیت وجود داشته دولت‌ها واکنش هایی چون واگرایی و مخالفت را بروز داده‌اند. http://www.iruns.ir/article_243027_e6c935997713185b4cbe600f25b6e716.pdf
