		<Abstract>This article examines the legal implications of Dr. Mohammad Mosaddegh’s actions in defending Iran’s sovereignty over the islands of Abu Musa, Greater Tunb, and Lesser Tunb, in the context of the doctrine of acquisitive prescription in international law. It first analyzes the legal framework governing the acquisition of territorial sovereignty, with a focus on the doctrine of acquisitive prescription—where continuous, peaceful, and unchallenged exercise of authority over a territory may, in limited circumstances, lead to a transfer of sovereignty. The article highlights the stringent conditions required for prescription to apply, emphasizing the necessity of uninterrupted and effective control by the occupying State and the absence of formal objections from the original sovereign. Through a detailed analysis of legal doctrine, international case law, and arbitral awards, it demonstrates that mere passage of time or unlawful occupation does not confer legal title. In this context, the study reviews Iran’s persistent and systematic protests against the British occupation of the islands, including diplomatic, administrative, and legal measures, with a focus on Mosaddegh’s tenure as Foreign Minister, Member of Parliament, and Prime Minister. It argues that Mosaddegh’s actions—such as formal protests, diplomatic communications, parliamentary advocacy, and administrative measures like the establishment of a civil registry on Abu Musa—constituted effective assertions of sovereignty, interrupting the temporal continuity required for acquisitive prescription. The study concludes that Iran’s legal and political efforts, successfully preserved its sovereignty over the islands and prevented the consolidation of British claims under the doctrine of prescription.</Abstract>
			<OtherAbstract Language="FA">این مقاله به بررسی پیامدهای حقوقی اقدامات دکتر محمد مصدق در دفاع از حاکمیت ایران بر جزایر ابوموسی، تنب بزرگ و تنب کوچک در چارچوب دکترین مرور زمانِ مُملک در حقوق بین‌الملل می‌پردازد. نخست، با تمرکز ویژه بر دکترین مرور زمان مملک که طبق آن، اِعمال مستمر، مسالمت‌آمیز و بدون اعتراض صلاحیت دولتی بر یک قلمرو ممکن است، تحت شرایطی خاص، به انتقال حاکمیت منجر گردد، چارچوب حقوقی حاکم بر اکتساب حاکمیت سرزمینی تحلیل می‌گردد. مقاله بر شرایط سخت‌گیرانۀ لازم برای تحقق این دکترین ازجمله لزوم کنترل مؤثر و بی‌وقفه توسط دولت متصرف و نبود اعتراض رسمی توسط صاحب اصلی حاکمیت تأکید می‌کند. مقاله، از رهگذر تحلیل دقیق آموزه‌های حقوقی، رویه دیوان‌های بین‌المللی و داوری‌، نشان می‌دهد که صرف گذر زمان یا اشغال غیرقانونی، موجد مالکیت حقوقی نیست. در این راستا، مقاله به بررسی اعتراضات مداوم و سازمان‌یافتۀ ایران علیه اشغال جزایر توسط بریتانیا می‌پردازد؛ اعتراضاتی که در قالب اقدامات دیپلماتیک، اداری و حقوقی به‌ویژه در دوران تصدی مصدق در مقام وزیر امور خارجه، نماینده مجلس و نخست‌وزیر صورت گرفته‌اند. مقاله استدلال می‌کند که اقدامات مصدق، از جمله اعتراضات رسمی، مکاتبات دیپلماتیک، پیگیری‌های پارلمانی و اقدامات اجرایی مانند تأسیس دفتر ثبت احوال در ابوموسی، بیان‌گر اِعمال مؤثر حاکمیت ایران بوده و تداوم زمانی لازم برای تحقق دکترین مرور زمان را مختل کرده است. سرانجام، این مطالعه نتیجه می‌گیرد که تلاش‌های حقوقی و سیاسی ایران، به‌طور مؤثری مانع تثبیت ادعای بریتانیا تحت دکترین مرور زمان شده و حاکمیت ایران بر جزایر مورد نظر را حفظ کرده است.</OtherAbstract>
