Journal Article 2025 04 08 The unilateralism of the United States in the global arena and its justifications for adopting some of its foreign policies, especially since the beginning of the new millennium, have led to the idea that the United States has moved beyond the multilateral order based on international law and wants to form a unipolar world centered on itself, and for this reason, it has replaced international law with the term "rules-based international order." In such a way that the term "international law" is not heard or seen in most speeches by American officials and correspondence and documents issued by government authorities, whether domestic or foreign. Of course, Europe also accompanies the United States in this program, with a slight difference in attitude and practice, which has caused China and Russia and their allies to object to this. In fact, the aforementioned governments consider this behavior of the West as a factor in increasing its hegemony at various political and economic levels and exercising surveillance and neo-colonialism over other regions of the world. While understanding the existing concerns, this article seeks to answer the question of whether the use of the term rules-based international order by the United States and its allies is a simple synonym for international law or a substitute for international law by referring to library sources, documents issued by Western governments, and examining their performance in the international arena. Considering the performance history of the United States, it seems that their intention is to replace international law with their own rules-based international order. یکجانبه‌گرایی ایالات متحده امریکا در عرصه جهانی و دلایل توجیهی آن برای اتخاذ برخی سیاست‌های خارجه خود بطور ویژه از آغاز هزاره جدید، سبب شده است تا این ایده مطرح گردد که ایالات متحده از نظم چندجانبه مبتنی بر حقوق بین‌الملل عبور کرده است و خواستار شکل‌گیری جهانی تک‌قطبی با محوریت خود است و به همین دلیل اصطلاح «نظم بین‌المللی مبتنی بر قواعد» را جایگزین حقوق بین‌الملل کرده است. به نحوی‌که در اکثر سخنرانی‌های مقامات امریکایی و مکاتبات و اسناد صادره از مراجع دولتی آن چه در حوزه داخلی و چه خارجی، اصطلاح حقوق بین‌الملل شنیده و دیده نمی‌شود. البته اروپا نیز با اندکی تفاوت در نگرش و عملکرد، ایالات متحده را در این برنامه همراهی می‌کند که سبب شده است کشورهای چین و روسیه و متحدان آنها به این امر معترض شوند. در واقع دولت‌های مزبور این رفتار غرب را به نوعی عاملی برای افزایش هژمونی خود در سطوح مختلف سیاسی و اقتصادی و اعمال نظارت و استعمار نو بر سایر مناطق جهان می‌دانند. مقاله حاضر ضمن درک نگرانی‌های موجود، با مراجعه به منابع کتابخانه‌ای، اسناد صادره از سوی دولت‌های غربی و بررسی عملکرد آنها در حوزه بین‌المللی درصدد پاسخ به این پرسش است که آیا کاربرد اصطلاح نظم بین‌المللی مبتنی بر قواعد از سوی امریکا و متحدان آن، مترادفی ساده برای حقوق بین‌الملل است و یا جایگزین آنها برای حقوق بین‌الملل؟ با توجه به سوابق عملکرد ایالات متحده به نظر می‌رسد که قصد آنها، جا انداختن نظم بین‌المللی مبتنی بر قواعد مدّنظر خود بجای حقوق بین‌الملل است. http://www.iruns.ir/article_224913_3a63590b2e4a6244861dd858cd348a33.pdf
