Journal Article 2024 02 25 During the recent attacks of Zionist regime on the Gaza Strip and other occupied territories, the Regime has committed a series of crimes which have been unprecedented in 75 years of history of occupation the Palestine territories.<br />When an »International Crime« occurs, the perpetrator or perpetrators of this crime have two » Individual criminal responsibility« for persons and »international responsibility« for the states of those persons, simultaneously.<br />Also, In the attacks on Gaza, all members of the international community have certain duties in terms of International Law; because when an »International crime« occurs, that matter is not limited only between the Victim country and the wrongdoing party, but it extends to »all countries« which assumed as »victims«.<br />In this kind of cases »all countries« have the responsibility of » preventing crimes«,» trying to stop crimes and not supporting criminals« and » pursuing and punishing criminals« as well. رژیم صهیونیستی اسرائیل در جریان حملات اخیر به نوار غزه و دیگر سرزمین‌های اشغالی مرتکب سلسله جنایاتی شده که به گواه تاریخ در طول ۷۵ سال اشغالگری آن رژیم در سرزمینهای فلسطین، بی سابقه بوده است.<br />به هنگام وقوع یک «جنایت بین المللی»، مرتکب یا مرتکبین این جنایات دارای دو نوع مسئولیت توامان می باشند؛ «مسئولیت کیفری فردی»، برای اشخاص حقیقی و «مسئولیت بین المللی» برای دولت متبوع این اشخاص، دو مسئولیت همزمانی است که در نتیجه یک جنایت بین المللی، بوجود می آیند.<br />علاوه بر این در حملات رژیم صهیونیستی اسرائیل به غزه، همه دولتها و اعضای جامعه جهانی دارای تکالیف و تعهدات خاصی از نظر حقوق بین الملل هستند، چرا که به هنگام وقوع یک «جنایت بین المللی» ، مساله صرفا در بین کشور قربانی و طرف خطاکار ، محدود نمانده و « تمامی کشورها» در برابر طرف جنایتکار، بعنوان « قربانی» محسوب می شوند.<br />«تمامی کشورها» در برابر جنایات ارتکابی یک بازیگر بین المللی، دارای مسئولیت سه گانه «پیشگیری از وقوع جنایت» ، «کوشش برای توقف جنایات و عدم حمایت از جنایتکار» و نهایتا «تعقیب، محاکمه و مجازات جنایتکاران» هستند. http://www.iruns.ir/article_191009_41ec0f186c82d268acf1776d09d2b994.pdf
