The function of tailored sanctions is to prevent human rights abuses and to maintain those values, as supported by peremptory norms of general international law (<em>jus cogens</em>). These sanctions, for example, are imposed on importing the goods for the production of which child labor has been used. These sanctions also prohibit the importation of goods or services from an illegally occupied territory. States as well as the UN Security Council may impose tailored sanctions as (unilateral or collective) a countermeasure. The present study is an attempt to explore the foundations and legality under international law of tailored sanctions. The special character of these sanctions is their obligatory nature. In contrast with general sanctions, tailored sanctions are considered not only states’ right but also their obligation. تحریم‌های مرتبط، به مجموعه ای از تحریمها اطلاق میگردد که معطوف به کالاها یا خدماتی است که در نتیجه نقض حقوق بشر تولید شده و یا منشاء تولید آن کالاها،، غیرقانونی است. این نوع تحریمها، اصولا برای جلوگیری از نقض حقوق بشر و یا پاسداری از قواعد آمره بین المللی وضع میشوند مثلا واردات کالاهایی که برای تولید آنها از کار کودکان استفاده شده است، تحریم میگردد و یا واردات کالا یا خدمات از سرزمینی که به صورت غیرقانونی اشغال شده است، ممنوع میشود. مرجع اعمال این تحریمها علاوه بر شورای امنیت سازمان ملل متحد، تمامی دولتهای عضو جامعه بین المللی هستند که در مقام اعمال «اقدام متقابل»، اقدام به وضع تحریمهای مرتبط مینمایند. پژوهش حاضر با هدف واکاوی مبانی و مشروعیت « تحریم‌های مرتبط» از منظر حقوق بین الملل به روش توصیفی- تحلیلی، به شیوه تحقیقات کتابخانه ای و با ابزار فیش برداری انجام شد. ویژگی خاص این نوع تحریمها، تکلیفی بودن آنهاست. برخلاف تحریمهای جامع، تحریمهای مرتبط، نه تنها حق دولتها بلکه به نوعی تکلیف آنهاست. http://www.iruns.ir/article_190592_603eb9b59528611dc1b4a13c00e10fee.pdf
