The main question of this article is what is the role of the mother in Iran` nationality law regarding the transfer of her nationality to the child? The Iranian legislature's approach in this regard was initially based on discrimination between Iranian parents in transferring nationality to their children, but gradually, this approach has been moving towards the elimination of discrimination. The Iranian legislature` approach in this regard should be examined in three different categories. In Civil code of Iran, the role of the mother was completely ignored. According to Single Act of 2006, in case of the child born in Iran of an Iranian mother and a foreign father, the nationality of Iran would be granted to the child. In 2019, this regulation was amended and children born abroad Iran are also granted Iranian nationality. But there is still a discrimination between the parents, because a child whose mother is Iranian and whose father is foreigner, will be granted Iranian nationality if it would not contrary to national security. Meanwhile, Iranian Nationality is granted to child born of Iranian Father and whose mother is foreigner unconditionally. رویکرد سنتی دولتها در اعطای تابعیت، مبتنی بر تبعیض میان پدر و مادر بوده است اما جنبش برابریخواهی، تغییری اساسی در رویکرد دولتها به نفع تساوی والدین ایجاد کرد. سوال اساسی این پژوهش آن است که چند کشور در جهان، از رویکرد تبعیض‌آمیز استفاده می‌کنند و موضع نظام حقوقی ایران در این ارتباط چیست؟ در حال حاضر، تنها 25 دولت در جهان، همچنان میان مادر و پدر در اعطای تابعیت به فرزند، تفاوت قائل هستند. در این مقاله، قوانین مختلف دولتها از جمله ایران، طی مطالعه‌ای تطبیقی بررسی گردید و کشورهایی که همچنان در این ارتباط، تبعیض‌آمیز عمل می‌کنند، مشخص شد. رویکرد قانونگذار ایران در این ارتباط را می‌بایست در سه مرحله مختلف بررسی کرد. در قانون مدنی، نقش مادر به کلی نادیده گرفته‌شده بود. به موجب ماده واحده سال 1385،درصورت تولد فرزند در ایران از مادر ایرانی و پدر خارجی، تابعیت ایران به فرزند اعطاء می‌گردید. در سال 1398 این مقرره اصلاح شد و به فرزندان متولد در خارج ایران نیز تابعیت ایران داده می‌شود. اما همچنان میان پدر و مادر تفاوت وجود دارد زیرا به فرزندی که مادرش ایرانی و پدرش خارجی است، تابعیت ایران در صورتی که خلاف مصالح امنیتی کشور نباشد، اعطاء خواهد شد. http://www.iruns.ir/article_168476_8b0084d14d62890f576b0dd668b5542a.pdf
